GENERAL TERMS AND CONDITIONS OF BUSINESS

§ 1 Scope

(1) These General Terms and Conditions (hereinafter referred to as "GTC") apply to all contracts concluded between

– hereinafter referred to as “Seller” – and the customer via the online shop at www.tat2table.de.

(2) For contracts with consumers, the version of the General Terms and Conditions valid at the time of the order shall apply.

(3) For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (Section 13 of the German Civil Code).

(4) Any terms and conditions of the customer that deviate from these will not be recognized unless the seller expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of the products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

(2) By clicking the “Order with obligation to pay” button (or similar), you submit a binding order for the goods contained in the shopping cart.

(3) Confirmation of receipt of the order will be sent immediately after the order is submitted via automated email. This order confirmation does not yet constitute acceptance of the offer.

(4) The purchase contract is concluded when the seller accepts the order by sending a shipping confirmation via e-mail or dispatches the goods.

§ 3 Prices and Payment Terms

(1) All prices are final prices and include statutory VAT. Any additional delivery and shipping costs are specified separately in the respective product description and during the ordering process.

(2) For deliveries to countries outside the European Union, additional costs may be incurred which are beyond the seller's control (e.g. customs duties, taxes). These costs shall be borne by the customer.

(3) The purchase price is due immediately upon conclusion of the contract.

(4) The following payment options are available:

Klarna (invoice, installment purchase, instant transfer)

(5) In the case of payment by Klarna invoice or installment purchase, Klarna's payment terms also apply.

§ 4 Delivery and Shipping

(1) Delivery is available within Germany and to selected EU countries. The available delivery countries are displayed during the ordering process.

(2) Shipping is via DHL . Delivery time is usually 3–7 working days within Germany, unless otherwise stated on the product page.

(3) For bulky goods or larger shipments, delivery may be made via freight forwarding. In this case, the customer will be contacted in advance.

(4) Shipping costs are displayed in the shopping cart and during the ordering process.

(5) If the customer has specified a delivery address that differs from the billing address, delivery will be made to the specified delivery address.

(6) The risk of accidental loss or accidental damage to the goods passes to the consumer upon delivery of the goods to the customer.

§ 5 Retention of Title

The delivered goods remain the property of the seller until full payment has been received.

§ 6 Right of withdrawal

Consumers have a statutory right of withdrawal. Detailed information on the right of withdrawal and a sample withdrawal form can be found on our withdrawal policy page.

§ 7 Warranty and Liability for Defects

(1) The statutory warranty rights apply.

(2) The warranty period for new goods shall be two years from the date of delivery to consumers.

(3) Obvious defects must be reported immediately, but no later than two weeks after receipt of the goods. Compliance with this time limit is not required to preserve warranty claims.

(4) If the purchased item is defective, the buyer may, at his option, demand subsequent performance in the form of rectification of the defect or delivery of a new, defect-free item. The seller is entitled to refuse the chosen type of subsequent performance if it is only possible at disproportionate cost.

§ 8 Liability

(1) The seller shall be liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body or health.

(2) In cases of slight negligence, the seller is only liable for breaches of essential contractual obligations (cardinal obligations). In these cases, liability is limited to foreseeable damages typical for this type of contract.

(3) Liability under the Product Liability Act remains unaffected.

§ 9 Dispute Resolution

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 11 Final Provisions

(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from this contract shall be the seller's place of business (Jena).

(3) Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
